One should remember that not all the Employees’ Provident Fund (EPF) members are eligible to apply for higher pension from EPS. Only certain employees who satisfy the eligibility requirements can apply for higher pension.

Once the eligibility criteria are determined, then one should collect the required documents to apply for higher EPS pension. Eligible employees, whose basic salary exceeds the notified wage ceiling limit, are required to provide proof that they have received permission from the EPF Commissioner to contribute to the EPF account on the basis of actual basic salary exceeding the notified limit (currently Rs 15,000 per month). However, practically such permissions were not taken from the EPF Commissioner to make contributions to the EPF account.

The court provided relief to the employees and allowed them to submit joint application forms without documents. The court asked the EPFO to bring these changes within 10 days. However, the EPFO is yet to provide clarity on the same.

Once the eligibility is determined and required documents are collected, then an employee can submit joint application form for higher pension on the EPFO’s Member Sewa portal.

The EPFO has issued a circular on April 23, 2023, clarifying how payment for additional dues will be made. Further, many eligible employees cannot see their past service records on the Member Sewa portal. The joint application form asks the employee to ensure that details submitted are correct.

Though the last date is on May 3, 2023, the EPFO is yet to provide clarity on how the additional 1.16% EPS contribution will be considered. The Supreme Court in its judgement has struck down the portion of EPFO 2014 notification which asked employees to make additional 1.16% contribution to the EPS account if higher EPS pension was opted at that time.
